Marriage can come to an end through two means:
1. Divorce
2. Anullment - This can occur when a marriage was undertaken on invalid grounds and is void.
Divorce is within the domain of the Commonwealth and therefore is sorted out through the Fedreal court system if it progresses this far. Only about 5% of all divorces need to be adjudicated by a judge.
If a family cannot organise the terms of their own divorce then they have to engage the family court to resolve the issues. This may result in a variety of orders being made to facilitate the divorce.
These can include: residence - which has replaced the term custody contact - which replaced the term access
The changes to these two terms were made to help change the mental state of parental rights to those of parental responsibility, and to also remove the idea that in the divorce someone was the winner.
maintenance - this can include maintenance for the children and sometimes for the spouse.
